Chemistry Club Constitution
Article I. Name

The name of the organization shall be Chemistry Club.

Article II. Purpose

The purpose of the Chemistry Club is to provide educational opportunities that demonstrate how abstract chemical theories are integral to daily life and to provide educational outreach program(s) to area youth.

Article III. Membership

Section 1. Any student at the University of South Dakota may become a member of the Chemistry Club regardless of race, color, religion, nationality, sex, national origin, age disability, sexual orientation, economic status, marital status, veteran status, or parenthood.

Section 2. In order to be considered an official member a student must pay his/her dues.

Section 3. The Chemistry Club executives shall consist of the President, Vice President, Secretary, Treasurer, and Webmaster.

Article IV. Election of Officers

Section 1. Dates: The executives shall be elected at the last Chemistry Club meeting of the Spring Semester.

Section 2. Nomination: Any candidate for an office must be nominated either in writing prior to the meeting or in person at the meeting.

Section 3. Election: All executives must be elected by majority vote. If only one person is nominated a voice vote may be used. If more than one person is nominated a secret ballot must be used.

Section 4. Terms of Office: The term of office for all executives shall begin after the Spring Semester in which they were elected has concluded.

Section 5. Vacancies:

a. If the office of President becomes vacant the Vice-President shall vacate his/her office and assume the office of President. If both offices become vacant the Secretary shall vacate his/her office and become the President.

b. If other offices become vacant, or if all the offices become vacant, a special election will be held at the next Chemistry Club meeting, provided that there is at least two week's notice.

Article V. Duties

Section 1. General Duties

a. All executives shall attend all Chemistry Club meetings and Chemistry Club executive meetings.

b. All members shall be encouraged to attend all Chemistry Club meetings.

Section 2. Duties of the President

a. The President shall set the agenda for meetings, preserve order and decorum, and in case of disorderly conduct by visitors or members may cause the same to be dismissed from the meeting.

b. The President shall not vote on any mater unless his/her vote is necessary to decide a tie vote.

c. The President shall keep a record of all the year's activities for the next year's President and other executives.

Section 3. Duties of the Vice-President

a. The Vice-President of the Chemistry Club is required to assume the responsibilities of the President in the event that he/she is absent.

Section 4. Duties of the Secretary

a. The Secretary shall keep minutes of the meetings and all correspondences of the Chemistry Club.

b. The Secretary shall provide a copy of the minutes to all members.

Section 5. Duties of the Treasurer

a. The Treasurer shall be responsible for the financial matters of the Chemistry Club, which includes the checkbook and any Student Government Association funding.

Section 6. Duties of the Webmaster

a. The Webmaster shall be responsible for maintaining the Chemistry Club website.

b. The Webmaster shall update the website at least once monthly to prevent it being archived.

c. The Webmaster shall post meeting dates, minutes, and any other announcements in a timely fashion as they are received.

Article VI. Procedure

Section 1. Meeting Times

a. The Chemistry Club shall meet at a time and place determined to be convenient by the Chemistry Club executives. The members shall be notified of meetings in advance.

Section 2. Items necessary for an issue to be introduced into the Chemistry Club

a. All bids, resolutions, etc., shall be introduced into the meeting by notifying the President.

b. All appropriation bills passed shall remain in effect only during the fiscal year in which they were passed, except by a majority vote.

c. All appropriations bills must state the amount to be drawn from the treasury.

d. Any person who is not a member will not be allowed to introduce legislation.

e. Any member who wishes to address the body shall be duly recognized by the President before he/she commences to address the body.

Section 3. Voting

a. A quorum shall be required for all voting matters. A quorum shall be defined as a simple majority of the voting membership.

b. All business transacted during an official meeting shall require a simple majority of those in attendance and shall be binding in the organization unless otherwise specified in the constitution or the by-laws.

Article VII. Impeachment

Section 1. Impeachable Offenses: The following shall be justifiable reasons for the removal of an officer or other member:

a. Misusing funds.

b. Unexcused or unaccounted for absences from three of more Chemistry Club meetings per semester.

c. Failure to perform assigned/official duties to a satisfactory level.

d. Behavior unbecoming of an officer or member of a recognized student organization.

Section 2. The Initial Process

If a member suspects an impeachable offense has occurred (see Section 1 for justifiable reasons), they must bring their concerns to the executives. The accused member shall have written notification of the charges against him/her. A hearing will be held with the executives, the accuser, and the accused present. The non-accused executives will determine by majority vote if there is sufficient evidence for impeachment. If so, the mater will be sent to a regular Chemistry Club meeting. The evidence will be heard and the non-executives will inform all members in advance of this matter.

Section 3. The Voting Process

After the evidence has been heard at a meeting a vote will be held to decide the fate of the member(s) in question. Each voting member will receive one (1) and only one (1) vote. There will be no voting by proxy. The vote to impeach must be approved by three-quarters (3/4) of the voting members present. The Advisor will oversee the voting process.

Section 4. Appeals

The defendant shall be allowed to appeal by bringing a legitimate reason to the executive board. The executive board shall vote on the appeal. If the appeal is approved than a retrial will be held at the next meeting.

Section 5.

Any officer accused of an impeachable offense shall lose his/her vote pertaining to impeachment or removal until the matter is resolved.

Article VIII. Amendments

Section 1.

Amendments to the Constitution may be made by a two-thirds (2/3) majority of those members present and voting. There will be one meeting's notice of changes in the rules.

Section 2. Ex Post Facto

Any changes to the Constitution that may jeopardize the eligibility of a member currently holding office will not become effective until the next regular election of officers if held.
